1. LICENSE AGREEMENT
This website is owned and operated by Tower Gaming Gaming SA and powered by OnGame Network Ltd. All transactions will be billed by OnGame Network Ltd., Europort, Suite 611, Gibraltar. On the Player’s bank statement, the transactions will be billed as either IFUND-POKERNETWORK or AquaPay London.
Ongame grants to Player a non-exclusive license, without sub-license rights, to use the Poker Software ("Software") subject to the terms of this Agreement. Tower Gaming Gaming and Ongame Network (together "Tower Gaming ") may modify this Agreement at any time without notice and Player shall periodically review this Agreement and any other terms and conditions posted at this Web site at a rate not less than once monthly. You shall not participate in the Games, open, use or reuse the Software, enter the Web site, or the card room, nor accept any prize if you do not fully understand, agree to, become a party to, and abide by, without exception, all rules, regulations and terms and conditions contained herein, which may change from time-to-time. The term of this Agreement will be automatically extended for three years from the date you receive any Tower Gaming Software upgrades or subsequent Tower Gaming Software versions.
2. REGISTRATION OF ACCOUNT
To play at Tower Gaming , you must first register for an account ("Account") by choosing a unique user ID ("User") and password after entering your true and current personal information. After registration with Tower Gaming you will be able to access both play money and real money games. Tower Gaming grants the User the right to install and run the Software on any computer for which it was designed. The User may only use the Software to connect to the Tower Gaming servers using valid and current registration information.
3. LICENSE RESTRICTIONS
You may not:
(a) permit other individual(s) to use the Software unless such other individual(s) agree(s) in writing to accept the terms of this Agreement;
(b) modify, translate, reverse engineer, de-compile, disassemble or create derivative works based upon the Software;
(c) copy the Software;
(d) rent, lease, transfer, sub license or otherwise transfer rights to the Software;
(e) remove any proprietary notices or labels on the Software, including the code underlying the Software; or
(f) use the Software for any reason other than your private or personal use.
4. LIMITATIONS ON USE
It is each Player's responsibility to follow his/her local gaming age restrictions. In any case, no person under the age of eighteen (18) is permitted to participate in games at Tower Gaming . YOU AGREE NOT TO USE THE SOFTWARE TO PARTICIPATE AT TOWER GAMING EXCEPT WHERE IT IS EXPRESSLY LEGAL TO DO SO. Residents of some locations are prohibited from playing Tower Gaming 's games for real money or prizes. It is the responsibility of each Player to know and abide by their jurisdiction's law relating to gaming.
No person will be allowed to have more than one account. Tower Gaming reserves the right to request a photocopy of a government issued ID, in order to verify a Player's identification. If a Player opens more than one account, Tower Gaming reserves the right to block play for all the Players accounts except one remaining account. It is the responsibility of the Player to cash-out any remaining funds from the blocked account(s). Any play money credits, poker points, tournament tickets or coupons within the blocked accounts are non-transferable and in such an instance shall be deemed null and void.
Only 1 real money account is allowed per household.
Tower Gaming reserves the right to close any other real money accounts that are traced to the same address or computer. In such a situation, any remaining funds may be cashed out by the Player. If promotional bonuses have been deposited into a duplicate account by Tower Gaming , Tower Gaming reserves the right to remove all bonuses paid into all linked accounts. If the return of an amount of money paid into either of the linked accounts by Tower Gaming is outstanding, Tower Gaming reserves the right to demand that the Player deposits a sum into Player's own account equal to the debt owed. This amount shall be removed by Tower Gaming in order to settle any outstanding debt.
A Player is only allowed to fund 2 real money accounts on behalf of other Players.
If a Player funds more than three accounts in total, i.e. his or her own and 2 other Players', Tower Gaming reserves the right to block play for all the accounts except one remaining account. It is the responsibility of the Player to cash-out any remaining funds from the blocked account(s). Any play money credits, poker points, tournament tickets or coupons within the blocked accounts are non-transferable and in such instance shall be deemed null and void.
Tower Gaming assumes no responsibility for the actions by you, the Player. You acknowledge that the games offered by Tower Gaming may be deemed an illegal activity in certain jurisdictions, and represent that Player has made a reasonable inquiry into the legality of gaming in the Player's country.
Tower Gaming is not responsible for claims for losses or damages resulting from real money play under any condition. Play at Tower Gaming is at the sole option, discretion and risk of the Player. Player is also responsible for maintaining the secrecy and security of their account passwords and other personal security information. Tower Gaming is not responsible for the unauthorized use of Player, the Player's, account or any losses that may result, of such unauthorized use.
Tower Gaming also has the right to hold any and all of a Player's funds indefinitely if Tower Gaming determines in its sole discretion that the Player has been involved in fraudulent activity in using Tower Gaming 's site. Fraudulent activity may include, but is not limited to, stolen credit cards, transfer of funds to other Player accounts (chip dumping), forgery, collusion and the provision of false account information.
You may only use the Software in accordance with the rules posted on the Tower Gaming site as may be modified from time to time. In cases where disputes arise between players, Player agree that judgments of Tower Gaming are final, binding and conclusive in all matters. All taxes, duties and fees applicable in connection with any money or prizes awarded to a Player are the Player's sole responsibility. Violation of any Tower Gaming policy or rule may result in suspension or termination of the Player's Tower Gaming account.
5. LIMITED WARRANTY
Tower Gaming does not warrant that the Player's use of the Software will be uninterrupted or that the operation of the Software will be error-free or secure. Tower Gaming does warrant to Player that the Software will operate for purposes of normal use for a period sixty (60) days from the date of this Agreement. In the event that this warranty is breached, Tower Gaming 's only obligation under this Agreement and at Tower Gaming 's option player's sole remedy is to either (a) have Tower Gaming replace Player Software with new Software supplied by Tower Gaming ; or (b) terminate this Agreement and return any fee, if any, Player paid to purchase the Software, provided that such fee will not include any costs resulting from Player's real money play.
6. LIMITATION OF LIABILITY
Tower Gaming is not responsible for any losses incurred by Player in real money play. The Software is provided "AS IS." THERE ARE NO WARRANTIES OF ANY KIND AS TO THE SOFTWARE'S IMPLIED MERCHANTABILITY OR TO FITNESS FOR A PARTICULAR PURPOSE, EVEN IF TOWER GAMING HAS BEEN ADVISED OF THAT PURPOSE. TOWER GAMING WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE EVEN IF TOWER GAMING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. This Agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is expressly excluded.
All Deposit and Withdrawal options may vary based on Player's country of residence. Availability of Deposit and Withdrawal methods may vary for all players and are subject to change.
7. HOLD HARMLESS AND REMEDY
You agree to hold harmless, indemnify and defend Tower Gaming , its officers, directors, employees and contractors, from and against any losses, damages, fines and expenses (including attorneys' fees and costs) resulting from your violation of any of the terms of this Agreement.
8. YOUR REPRESENTATIONS AND WARRANTIES
You hereby represent and warrant to us as follows:
A. You have read and you understand this Agreement.
B. The execution, delivery and performance by you of this Agreement and the consummation by you of the transactions contemplated hereby will not, with or without the giving of prior notice, the lapse of time or both, conflict with or violate: (i) any provision of law, rule or regulation to which Player is subject; (ii) any order, judgment, decree,or other instrument applicable to Player or binding upon Player's assets or properties.
9. SEVERABILITY
If any provision of this Agreement is found by a court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability will not invalidate or render unenforceable any other part of this Agreement so that the Agreement will be construed as not containing the particular provision or provisions held to be invalid or unenforceable.
10. INFORMATION COLLECTION
Tower Gaming will collect information from browsers through using “cookies”. The information will be, for example, the type of browser Player use, your I.P. number, etc. This information is collected for security reasons with the aim of constantly improving our Web site to better meet Player needs.
Tower Gaming uses a session-cookie to authenticate our customers after login. This cookie is terminated as soon as Player logs out from Player's account. Tower Gaming will always strive to not make unnecessary use of cookies.
11. E-MAILS
Should Player no longer wish to receive account updates and promotional offers, Player may visit Player's 'My Account' page and tick the box to not receive newsletters.

13. REAL MONEY PLAY RESTRICTIONS
Because of inadequate transaction processing for Players from United States, Canada, Costa Rica, Israel, Turkey, Afghanistan, Burma/Myanmar, Democratic Republic of Congo, Federal Republic of Yugoslavia & Serbia (including Kosovo), Iran, Iraq, Ivory Coast, Lebanon, Liberia, North Korea, Rwanda, Sierra, Leone, Somalia, Sudan, Syria, & Zimbabwe, Tower Gaming Gaming does not accept any new Real Money Players from those countries.
This restriction has been implemented , however it may be subject to change with the development of new deposit/withdrawal services. Unless federal laws where the Player is based state otherwise, existing Real Money Players from these countries or new Players wishing to sign up for a Play Money account may play on the site.
14. EQUAL IN EQUAL OUT POLICY
Tower Gaming has an agreement with the merchants, NETELLER and the various credit/debit card companies to the effect that when a Player deposits through a certain deposit option the Player will have to withdraw back through the the same option up to the total amount deposited, before the withdrawn amount can be made by any other means.
For example, if Player have deposited $100 three times (total $300) through NETELLER in total, and Player wants to withdraw $500 by check. By default we will send $300 to Player's NETELLER account and $200 by check.
IN ADDITION AND IN AGREEMENT WITH THIS LICENSE, THE USER IS REQUIRED TO READ THE ADDITIONAL TABS TITLED "ABOUT TOWER GAMING GAMING", "TOWER GAMING TRUST AND SECURITY ", AND "PROHIBITED PROGRAM POLICY".
15. MAP - MULTI ACCOUNT POLICY
Ongame Network allows players to register accounts with multiple Network Operators, but has the policy that an individual may only register for any single tournament from one of these accounts.
Any player who plays in a tournament from multiple player accounts will be in violation of this policy and suffer the following consequences:
- They will be disqualified from a tournament in-progress if the violation is detected in real-time.
- All money in all their player accounts with Ongame Network operators will be confiscated, and the accounts closed.
- They will be permanently banned from playing on Ongame Network.
When these banned players are caught, their money will be confiscated and their account closed.
At the Network’s discretion, tournament pay-outs (the distribution of tournament prize monies to winners) can be held for up to 14 days if an investigation is required (though we will try to conclude all investigations within 72 hours). Investigations are predicated on automatic processes and manual checks conducted by separate support and security teams both during and after tournaments.
Where an investigation determines there is or has been a serious problem, all accounts suspected of being involved may be frozen for the duration of the investigation. This means that players will not be able to log-in or play, and they will not be able to withdraw or transfer funds. We recognize that this will be an inconvenience and we regret that this may affect innocent players.
Where an investigation requires that tournament pay-outs be held pending distribution to winners, we will endeavour to communicate this to all players involved shortly after the tournament concludes.
Ongame Network has the policy of not sharing the results of its investigations. However, where appropriate, both the results and actions being taken will be made available to players through our Operators’ websites. If prizes need to be redistributed, this information will be provided directly to players.
Ongame Network recognizes that it is critically important to provide safe gaming for all our players, and to ensure that our card room is fair. We go to great lengths to eliminate all unfair advantages and are removing the potential advantage provided by using multiple accounts to register for a tournament. Note that we are advised by David Sklansky in respect to preventing various forms of collusion, and appreciate his expertise.
We also want to be clear that cheating of any kind will absolutely not be tolerated.
16. TOURNAMENT COLLUSION REFUND POLICY
This refund policy is an attachment to the Tower Gaming Gaming.com Terms of Service and the Ongame Network MAP Multi Account Policy. As such it cannot be reviewed as a stand-alone Policy nor does it overrule these documents in case of confliction. Please read through the above two documents before proceeding.
This Refund Policy covers Tower Gaming Gaming.com accounts and Tower Gaming Gaming.com accounts only. Accounts affiliated with other operators within the network will not benefit from it.
This Refund Policy details reimbursement rules in cases of confirmed tournament collusion. The punitive measures enforced upon caught colluders - although mentioned - are regulated by the Ongame Network multi-account Policy.
This policy has been engineered to provide just treatment in the case of cheating being determined in tournaments. All decisions will be made by Tower Gaming Gaming.com and cannot be overruled. Detailed information regarding our investigations – and the investigations made by the Ongame Network Security Team - will be released at our discretion.
Affected players will be contacted and refunded through Support.
The policy deals with three separate types of tournament collusion; checkdowns, chip dumping and co-op play (multi-accounting).
Checkdown
Checking down can occur when two or more players call an all-in player. On Tower Gaming Gaming.com it is against the rules and ethics of the game of poker to expressively agree upon this conduct. Equally it is against the rules to suggest such an action. However, merely suggesting it does not equate collusion.
Players found guilty of verbally agreeing to not play each other in a hand with the explicit intent of maximizing the chance of eliminating a third player will receive a warning. Repeat offenders risk having any prize money forfeited.
In confirmed cases, if he loses the hand, the all-in player will be refunded a ticket EQUAL to the value of the entered tournament.
Chip Dumping
Tournament chip dumping is defined as a situation where one player purposely loses chips to another player with the sole intent of increasing their combined chances of winning prize money. Chip Dumping will incur a permanent ban of all involved accounts and the forfeit of all the total value of prize money.
In cases of confirmed chip dumping, all REMAINING players in the event, at the time of the offence, will have the total value of the forfeited prize money split amongst them.
Co-op Play (multi-accounting)
Co-op play is defined as situations where one or more players enter a total of two or more accounts into a tournament (scheduled or sit-n-go) and are sharing, or attempting to share, information about hands or players between them. Sharing information includes playing the accounts from the same computer, using online messaging services or any other form of off- or online communication.
All Co-op play accounts will be permanently banned and risk, based on the Ongame Network multi-account policy, having their prize money and their entire bankroll ceased. In all cases of multi-account collusion we will also initiate a full investigation into related accounts. The individuals behind all caught accounts are not welcome to play on Tower Gaming Gaming.com under any circumstances.
In cases of multi-account collusion, the forfeited prize money will be split amongst all players who entered the event in question.
17. PROHIBITED PROGRAM POLICY
Background and purpose
We recognize that people want to become better poker players so they can improve their performance at our tables. There are a number of techniques that can be used to achieve this goal. In our opinion, not all of the existent tools are consistent with "fair play". The purpose of this policy is to separate acceptable techniques of performance improvement from techniques that are prohibited on Tower Gaming.
First of all, we would like to emphasize that education and experience are the strongest ways to develop a more successful game. We encourage this, and recommend worthwhile books for players interested in improving. We also recognize that numerous software tools are available which promise to help players improve their game performance. After consultation with many of our players, including professional poker players and top poker industry experts, we have decided to clearly separate these programs into two categories: 1) software tools that provide a fair advantage to a player and are allowed; and 2) software tools that provide an unfair advantage to a player and are prohibited. We both warn and promise players that we have a strict policy towards the use of prohibited programs. While there is a zero-tolerance policy in effect towards "poker bot" usage, collusion and other forms of cheating, we may allow players to continue playing if they stop using a prohibited program.
We want to keep our games fair for everyone and will take necessary steps to ensure this. For this reason, we reserve the right to change this policy at any time.
Poker Bots
We believe that players who use automated "poker bot" programs to make decisions or take actions on their behalf in games are cheating. All players must be comfortable and secure that they are technologically equal in our card room. To ensure this, we have banned the use of these programs. To be clear, players are prohibited from operating these programs or allowing these programs to operate while logged into their accounts. This prohibition includes all games, including tournaments and ring games, for all currencies, including real money and play money. Only humans are permitted to play on our site. Artificially-intelligent programs, processes, applications and all other forms of software and hardware - including those commonly referred to as "Poker Bots" or "Auto Folders"- are prohibited from making game decisions or taking game action on our site, either under their own auspices or under the supervision of a human.
Fair and unfair advantage
Through analysis of hand histories, players can learn about patterns, strengths and weaknesses in their game play (and that of their opponents), and determine areas for improvement. We provide a comprehensive hand history statistics in our software, but recognize some players want more [granular] specific details than that.
Programs that aggregate hand histories to profile a player’s own play and/or the play of opponent players at the same poker table, are allowed. PokerTracker and Texas Calculatem, for example, are programs that provide detailed statistical analysis of hand histories for beneficial review. As well as personal game play analysis, these programs also compile and profile a player's opponents' play. This is similar to how a meticulous player might use our "Player Notes" feature after every hand to compile their own profiles on opponents. As such, these programs are allowed. Conversely, programs that use statistics not collected by the player himself/herself through ordinary, fair game play, are not allowed. Programs that share data are not allowed. Further, we do not allow players to collude, share hole card information or team up against other players. We also prohibit the use of any software program that facilitates the sharing of this information or player profiles.
PokerEdge and CardAnalyzer, for example, are programs that compile player profiles in a database and then sell subscription access to their systems. These programs allow players to access profile information on players they have never played against, and we believe this provides an unfair advantage. As such, these programs are prohibited.

We currently have sophisticated processes in place to detect and prevent the use of prohibited programs. This technology is an extension of our anti-collusion security systems, and is deeply integrated with multiple tiers of our client and server architecture. It is in our collective interest to ensure the safety and integrity of the game and this is part of the security we offer all our players. We reserve the right to close accounts, seize funds and ban players from playing on Tower Gaming for using prohibited programs or cheating.

Transfer and/or license, without prior notice, the rights and the liabilities regarding an Account Holder to any other legal entity, in any country, subject to OddsMatrix guaranteeing the liabilities being honoured. Hold and manage funds belonging to Account Holders in accordance with generally accepted guidelines for cash management regarding such funds; this may include a Financial Institution and/or a Payment Solution Provider being entrusted to hold funds in the name of and/or for the benefit of Account Holders; Forfeit and/or confiscate funds available on an OddsMatrix Account and/or refuse to honour a claim, in the event that, directly or indirectly, The OddsMatrix Rules have been violated and/or other unauthorised activities have occurred in connection with a betting event and/or the operation of an OddsMatrix Account. |

| 2.3 | An individual applying to become an Account Holder warrants and represents not to be under the age of 18 years. |
| 2.4 | An Account Holder warrants and represents, at all times, not to be: |
Resident of Malta, Turkey or the United States of America; Restricted by limited legal capacity; Acting on behalf of another party; Classified as a compulsive gambler; Depositing monies originating from criminal and/or other un-authorized activities; Depositing monies through a Credit Card which the Account Holder is not authorised to use and/or utilising a Credit Card in a jurisdiction in which betting and gaming are prohibited; Conducting criminal activities whereby an OddsMatrix Account is directly or indirectly involved; and/or |

| 2.5 | OddsMatrix warrants and represents, at all times, to: |
Manage funds belonging to Account Holders in a secure and appropriate manner; and/or Absorb the cost of, and pay, the Betting Duty, as applicable, at the place of Contract. Manage data regarding an Account Holder in accordance with applicable laws, data protection acts and/or similar. |

| 2.6 | An OddsMatrix Account is opened, held and settled in a currency as agreed between OddsMatrix and an Account Holder. OddsMatrix calculates and settles all matters involving exchange rates in accordance with recognised financial institutions at currently applicable exchange rates. Slight differences may occur between agreed amounts and recorded amounts due to variances between exchange rates. |
| 2.7 | An OddsMatrix Account does not accrue interest. |
| 2.8 | An Account Holder can only hold one OddsMatrix Account at a time. |
| 2.9 | Any claim regarding a transaction in conjunction with an OddsMatrix Account shall be made to OddsMatrix within 6 months after the transaction, payment and/or settlement took place, or should have taken place, otherwise OddsMatrix reserves the right at its own discretion to not pay attention to the claim. |
| 2.10 | Any legal dispute regarding a transaction in conjunction with a OddsMatrix Account that cannot be solved by the OddsMatrix Rules, including, but not limited to the right of OddsMatrix, at its own discretion, at all times, to resolve any disputes, in accordance with principles of equity, shall be settled in accordance with the Governing Law of the Place of the Contract. |
| 2.11 | An Account Holder can liquidate the OddsMatrix Account at any time. The credit which exists on the OddsMatrix Account at this moment will be paid out after the application. The personal data will be coded and stored. |
In the case of liquidation of an OddsMatrix Account, irrespective of the cause, the data stored will be deleted after a period of 5 years if the Account Holder so requests. As the stored data is supposed to be available in any possible case of assertion of claims in courts or authorities a deletion before the expiry of the period of 5 years is not possible. The deletion of personal data will take place after the expiry of the legal limitation period. |

| 3.1 | Deposits to, and withdrawals from, an OddsMatrix Account shall at all times be made through a Financial Institution. Procedures, terms and conditions may vary from time to time, as well as between different countries and different Financial Institutions. Current advice is available when logged in on the Site under the headings "Deposit" or "Withdrawal". |
| 3.2 | OddsMatrix may appoint a Payment Solution Provider to act, receive deposits, hold and manage funds, and/or expedite withdrawals, on behalf of OddsMatrix. |
| 3.3 | OddsMatrix does not accept cash funds sent or delivered directly to OddsMatrix or a Payment Solution Provider. |
| 3.4 | An Account Holder may only make a deposit with a Credit Card registered in their own name. |
| 3.5 | Withdrawals from an OddsMatrix Account are made through payments addressed to the Account Holder or transferred to a bank account held in the name of the Account Holder, as advised by the Account Holder. |
| 3.6 | Placing a bet through the Internet may be illegal in the jurisdiction in which an Account Holder is resident and/or domiciled; if so the Account Holder is not authorized to use a Credit Card for the purpose of placing a bet. |
| 4.1 | OddsMatrix uphold strict confidentiality regarding all relations with an Account Holder. This can only be breached by a decision deriving from the Governing Law and/or in the event of an Account Holder violating the OddsMatrix Rules |
| 4.2 | An Account Holder is given a personal account number. The Account Holder chooses a password and username. It is an Account Holder's own responsibility not to share this information. If the Account Holder has reason to believe that others have become party to this information, the Account Holder should immediately contact OddsMatrix' Customer Service and a new password will be issued. |
| 4.3 | All telephone communications between Account Holders and OddsMatrix are recorded for security, training purposes and/or accounting purposes. |
| 4.4 | All Internet communications are kept on record for accounting purposes. |
| 4.5 | Credit Card deposits may, from time to time, be partially and/or fully declined subject to certain security systems managed in collaboration with a Payment Solution Provider and/or a Financial Institution. Such security measures may decline legitimate Credit Cards, which nevertheless, at a particular time, it is not possible to process. OddsMatrix personnel do not control the said systems, nor have they any knowledge, of the reasons for any deposits being declined. |
| 4.6 | OddsMatrix may request documents to verify identity and/or authorization to use a specific Credit Card and/or other facts provided by the Account Holder, before expediting deposits and/or withdrawals; this may cause slight delays. |
| 5.1 | Definitions: |

| 5.1.7 | "Outright" is where it is possible to Bet according to a specific offer. |
| 5.1.8 | "Over/Under" is where it is possible to Bet on the outcome of a virtual match or event, defined by OddsMatrix, which forms part of an officially organised event or match. Bet is valid for full time if nothing else is stated. |
| 5.1.9 | "Odd/Even" is where it is possible to Bet on the outcome of a virtual match or event, defined by OddsMatrix, which forms part of an officially organised event or match. "Odd" is 1, 3, 5 etc.; "Even" is 0, 2, 4 etc. Bet is valid for full time if nothing else is stated. |
| 5.1.10 | "Head-to-Head" and "Triple-Head" are where it is possible to Bet on the outcome of a virtual match or event, defined by OddsMatrix, which forms part of an officially organised event or match. |
| 5.1.11 | "Influence Betting" is an act, prohibited by OddsMatrix, where an Account Holder, or parties acting in association with an Account Holder, can influence the outcome of a match or an event - directly or indirectly. |
| 5.1.12 | "Syndicate Betting" is an act, prohibited by OddsMatrix, where an Account Holder, or parties acting in association with an Account Holder, evades the Rules of OddsMatrix - directly or indirectly. |
| 5.1.13 | "Error" is a mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, technical hazard, registration error, transaction error, manifest error, Force Majeure and/or similar. |
| 5.1.14 | "The Result" is the official result as first declared by the governing association of the match or the event, as the full time result, notwithstanding the match or event being shortened, later changes of the official result and/or Errors. |
| 5.1.15 | "Participant" is an object constituting part of an event. In "Head-to-Head" and "Triple-Head" Participants only refer to objects which are subject to the "Head-to-Head" or "Triple-Head" event in question. |
| 5.1.16 | "Livebetting" is where it is possible to Bet during an ongoing match or event. OddsMatrix does not acknowledge or accept any liability whatsoever if it not possible to place a Bet. At all times it is the Account Holder's responsibility to be aware about the score. All bets are settled according to general betting rules. |
| 5.1.17 | "Neutral Ground" or similar information is considered as added information but OddsMatrix does not acknowledge or accept any liability whatsoever if any neutral venues are not correct or not listed as such. At all times it is the Account Holder's responsibility to be aware about the match venue. |
| 5.1.18 | "Half time/Full time" is where it is possible to Bet on the result in half time and the outcome of the match. Bet is void the match is played in a different time format. Bet is valid for full time if nothing else is stated. |
| 5.1.19 | "Special bet offers" as first goal scorer, first corner, first penalty, first throw-in, half time result, over/under, fantasy matches and similar bet offers are considered as valid bets if the outcome of the bet cannot change even though the match or event at a later stage is abandoned or there is no official result or the result is changed by the governing association irrespective when the decision is taken. |
| 5.1.20 | "Full time" is defined by the official rules published by respective governing association. For example in football full time is stipulated to 90 minutes including injury time. The settle of a bet offer is in first hand based of the official statistics as first declared by the governing association. If the governing association does not publish certain statistics and/or there is an obvious error the settle of the bet offer will be based on other public sources |
| 5.1.21 | Statistics or editorial text published at the OddsMatrix site is to be considered as added information but OddsMatrix does not acknowledge or accept any liability whatsoever if the information is not correct. At all times it is the Account Holder's responsibility to be aware about circumstances relating to an event. |
| 5.2 | A Bet: |
Can only be placed by an Account Holder; Can only be accepted through the Internet or by phone unless other arrangements have been agreed; Is valid only after OddsMatrix has accepted the Bet and the Account Holder has confirmed the Account Holder's wish; A Bet confirmed by the Account Holder cannot later be changed or cancelled, unless declared void; Is debited to the OddsMatrix Account of the Account Holder; Cannot be made in excess of the amount held in credit on the OddsMatrix Account; Is made at the fixed odds at the time of acceptance by OddsMatrix, unless otherwise stated; On Head-to-Head and Triple-Head is made at the fixed odds at the time of acceptance by OddsMatrix, subject to all participants in the Head-to-Head or Triple-Head starting; Is always accepted at OddsMatrix's discretion; and The amount can be limited at OddsMatrix's discretion. |

| 5.3 | Match betting allows singles as a minimum and ten-folds as a maximum, unless other arrangements have been agreed. |
| 5.4 | Net Winning, in one or more Bets, involving an identical outcome, is limited as follows: |
Net Winnings from your bet(s) through the Internet, may not exceed EUR 20 000 If Bet(s) in excess of the aforementioned limits are accepted in Error, the excess will be disregarded unless other arrangements have been explicitly agreed. |

| 5.5 | Irrespective whether the aforementioned limits are reached or not, the amount accepted for Bet(s) can be limited, prior to acceptance, at OddsMatrix's discretion. |
| 5.6 | A bet can be declared void, and is in that event settled with the odds of 1.00. |
| 5.7 | A Bet made as an accumulative bet, shall remain valid, notwithstanding a match or an event which is part of the accumulative Bet being void. |
| 5.8 | OddsMatrix reserves the right, at its own discretion, to declare a Bet void, totally or partly, if it is obvious that: |
Bets have been offered, placed and/or accepted due to an Error; Bets have been placed after the event has started; Syndicate Betting has occurred; Influence Betting has occurred; and/or A Result has been affected by criminal actions - directly or indirectly. |

| 5.9 | If two or more Participants share certain finishing positions, the odds are divided by the number of participants sharing those certain positions and settled accordingly. |
| 5.10 | A Payout is credited to the OddsMatrix Account of the Account Holder. |
| 5.11 | OddsMatrix reserves the right, at its own discretion, to adjust a Payout credited to a OddsMatrix Account if it is obvious that the Payout has been credited to a OddsMatrix Account due to an Error. |
| 5.12 | OddsMatrix reserves the right, from time to time, to adjust, amend and adopt special rules, subject to special conditions, applicable for particular matches or events that may be contradictory to the Betting Rules as above. |
The Betting Rules are applicable to all games and transactions with OddsMatrix, and may be supplemented with other Rules. Those special rules may either be published herein, under the heading "Betting Rules" or in conjunction with published odds for those particular matches or events. In the event of ambiguity, priority is as follows: a) A Rule published in conjunction with an offer. b) A Rule published under the heading Special Rules. c) A Rule published under the heading Betting Rules. |

| 7.1 | The OddsMatrix Rules as published from time to time in English govern this Contract. Translations into other languages are made as a service and are made in good faith. However, in the event of ambiguity between the English version and a translation, the English version has priority over any translations. |
| 7.2 | Account Holders are advised to comply with applicable legislation in the jurisdiction in which they are domiciled and/or resident. |
| 7.3 | OddsMatrix does not provide advice to Account Holders regarding tax and/or legal matters. |
| 7.4 | Account Holders that wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors and/or authorities in the jurisdiction in which they are domiciled and/or resident. |
| 7.5 | OddsMatrix does not acknowledge or accept any liability whatsoever for damage to an Account Holder and/or a third party caused directly and/or indirectly due to any: |
a) Mistake, misprint, misinterpretation, mishearing, misreading, mistranslation, spelling mistake, fault in reading, transaction error, technical hazard, registration error, manifest error, Force Majeure and/or any other similar event; b) Violation of the OddsMatrix Rules; c) Criminal Actions; d) Advice provided by OddsMatrix e) Financial risk and loss, including, but not limited to variances in exchange rates; and/or f) Legal actions and/or other remedies.

| 7.6 | OddsMatrix reserves the right, at all times, to resolve any disputes, at its own discretion, in accordance with principles of equity. |
| 7.7 | In the event that OddsMatrix is found liable in any way, by a court of law and/or a similar authority, with legal competence and/or jurisdiction over OddsMatrix, then OddsMatrix' liability is limited to the amount of the Stake, or the Net Winnings, whichever is the lesser. Alternatively, when relevant and applicable, the amount recorded in the OddsMatrix Account or the amount transferred into or out of the OddsMatrix Account, whichever is the lesser. |
| 8.1 | OddsMatrix adheres to the Data Protection Act, other relevant regulations, legal notices and/or similar at the Place of the Contract taking account of the Data Protection Directive (EC Directive 95/46/EC) and the Electronic Communications Privacy Directive (EC Directive/2002/58/EC. |
| 8.2 | Furthermore, OddsMatrix has adopted best practice when it comes to the principles of e-mail communication with Account Holders. |
| 8.3 | All the aforementioned is in place in order to assure Account Holders that at all times personal data is: |
a) processed in accordance with the rights of the Account Holder concerned; b) processed fairly and lawfully; c) obtained only for a specific and lawful purpose; d) adequate,relevant and not excessive to its purpose; e) accurate and updated; f) kept in a secure manner; g) not kept longer than is necessary for its purpose; h) not transferred to jurisdictions not adhering to the aforementioned Directives; and i) Is utipzed for marketing purposes based on the so called opt-in principle. |

| 8.4 | OddsMatrix discloses personal data when ordered to do so by order of the Governing Authorities and/or under provision in the Governing Law. For fraud detection and control purposes you agree that OddsMatrix has the right to transfer your personal data to third parties, including so-called AVS service providers and other partners. |
